Acuerdo de licencia de usuario final

El texto en inglés de este documento es la versión legal vinculante. Cualquier traducción es solo por conveniencia.
1. License grant
Video Blackout is free software under the GNU Affero General Public License version 3 (AGPL-3.0). You may use, study, modify, and redistribute the Software under that license. There is no warranty. The program includes the AGPL-3.0 model yolo11n-face.onnx, so the whole application is AGPL-3.0. The license text ships with the app in legal/AGPL-3.0.txt. Corresponding source is published at https://github.com/topworld87/VideoRedactionAPP. A paid subscription is a separate service for the official build: it sets the device count, export length, and watermark on the pricing page. It does not replace AGPL-3.0 and does not forbid use, modification, or redistribution of the Software.
Unlicensed or trial modes may impose watermarks, duration caps, disabled export, or other limits. Those limits are part of the license, not a failure of the Software.
2. Restrictions
You will not:
- Share, resell, or clone subscription seats or license keys, or circumvent device limits and hardware binding on an official paid build.
- Remove the copyright notice or the AGPL-3.0 license text.
- Process footage you are not authorised to handle, including child sexual abuse material, or use outputs to harass, dox, or commit a crime.
AGPL-3.0 does not allow a ban on copying, redistribution, modification, or reverse engineering of the Software. No such ban applies. You do not need to ask us before reading or modifying the source.
3. Ownership
We and our licensors own the Software, models, UI, and documentation. This EULA does not assign copyright or trade secrets to you. Output files you generate from your source video are your files, subject to third-party rights in the underlying recording and to Section 6 (no warranty that the output is legally sufficient).
4. Activation and internet
Activation uses this website: you sign in, we bind a license to a hardware identifier, and the app stores a license locally. After activation, ordinary redaction does not require the internet. We may require occasional re-validation if the subscription lapses, the device changes, or we detect abuse. You are responsible for installing updates you choose to install.
5. Third-party components
The Software includes open-source components under their own licenses, listed in legal/NOTICE.txt. The application as a whole is AGPL-3.0, as stated in section 1. Nothing in this EULA limits your rights under AGPL-3.0 or under another open-source license that applies to a component.
6. High-stakes use; no fail-safe
The Software is not a fail-safe system. It is not designed as the sole control for life-safety, criminal charging decisions, or automatic public release. You must not rely on detection confidence scores (if shown) as a legal determination. You agree to maintain a human review step before any external disclosure of an export.
7. No warranty
THE SOFTWARE IS PROVIDED “AS IS.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DETECTION IS COMPLETE, THAT MOSAIC/BLUR/SOLID FILL CANNOT BE ATTACKED IN EVERY hypothetical forensic scenario, THAT AUDIO RANGES MATCH SPEECH, OR THAT ANY EXPORT SATISFIES FOIA, GDPR, HIPAA, CJIS, COURT RULES, OR YOUR INTERNAL POLICY.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR FINES, REGULATORY PENALTIES, LOST PROFITS, OR THIRD-PARTY CLAIMS ARISING FROM YOUR USE OR DISCLOSURE OF EXPORTS. OUR AGGREGATE LIABILITY UNDER THIS EULA WILL NOT EXCEED THE FEES YOU PAID FOR THE SOFTWARE LICENSE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR USD 100 IF YOU PAID NOTHING.
9. Indemnity
You will indemnify and hold us harmless from claims arising out of your use of the Software, your footage, your exports, alleged incomplete redaction, and your failure to review — to the same extent as in the Terms of Service.
10. Term and termination
This EULA lasts until your license ends or we terminate for breach. On termination you must cease use and uninstall the Software. Exports already written to disk are not deleted by this clause; your records policy still applies. Survival: Sections 2, 3, 6–9, 11–12.
11. Export and government
You will not export or re-export the Software in violation of applicable export-control or sanctions laws. If you are a government user, the Software is commercial computer software; only the rights in this EULA are granted.
12. Governing law
This EULA uses the same governing-law, venue, informal-dispute, and general provisions as the Terms of Service. English is the controlling language if a translation differs.
